A security guard charged with reckless endangerment after he shot at a fleeing robbery suspect in Aurora says he fired because he thought the robber was reaching for a weapon.
The Aurora Sentinel reports that police say 26-year-old Avery Marquis Nelson created a risk of "serious bodily injury to the public" when he discharged his firearm at the suspect, who allegedly robbed a Subway restaurant.
Police say Nelson used pepper spray on the suspect before drawing his weapon and firing into the air as the suspect got inside his vehicle and drove off.
When his non-lethal attempts failed to stop the man, Nelson says he fired at the vehicle because he believed the man was reaching for a weapon.
Police are still looking for the suspect.
