FORT COLLINS, Colo. (AP) — No charges will be filed against a driver who hit and killed a 6-year-old Colorado boy in a crosswalk outside his school.

Fort Collins Police Chief Jeff Swoboda announced the findings of the investigation into the November crash that killed Vale Wolkow on Thursday, calling it a “tragic accident,” the Coloradoan reported.

Police said an 23-year-old driver whom they didn’t identify stopped his SUV at an intersection at a four-way stop to make sure it was clear of pedestrians before proceeding. At the same time, Wolkow and his 9-year-old brother waved to a driver going through the intersection the opposite direction and then proceeded into the crosswalk.

Police said the SUV braked but was unable to avoid hitting Wolkow. Police say the driver wasn’t speeding and neither sun glare or distracted driving were factors. However, they say the driver side-pillar along his windshield partially blocked his view of the children.
