A Colorado Springs man accused of his ninth DUI charge has been released from jail, but with several restrictions.
William Nance, 54, was arrested on September 7 after a crash.
Nance said he was not drinking and driving, but refused a field sobriety test, according to court records obtained by KRDO-TV. Police said they found a case of beer in his car, as well as two open and partially empty cans in his car.
The TV station said Nance is not allowed to drink alcohol, will face random testing and must wear an ankle monitor.
Given his prior DUI offenses, Nance's latest arrest qualifies for a possible felony charge under a state law that took effect last month. That law makes a fourth DUI a felony that can be punishable by up to six years in prison.
Prior to the new law, DUIs in Colorado were treated as misdemeanors regardless of how many previous convictions a driver had.
