Tax on sugary drinks heads to Boulder voters

BOULDER, Colo. — Sugary drinks could soon be taxed in Boulder if a ballot measure passes this November.

A judge Tuesday ruled against a motion claiming the petition to the measure on the ballot was invalid.

If the measure passes this fall, there would be a two cent per ounce tax added to soda and other sugary drinks. 

The measure is an excise tax on the distributor, not a sales tax on the consumer. Distributors would have the discretion of whether to pass those costs along to the customer.
