Prosecutors are no longer pursuing the case against a man who filmed officers pulling him from a vehicle and patting down his handcuffed brother during a stop over a cracked windshield.
The Colorado Springs Gazette reports 4th Judicial District Attorney's Office spokeswoman Lee Richards said prosecutors moved to dismiss the case because no one was injured and the brother pleaded guilty to lacking compulsory insurance and having an obstructed view due to a cracked windshield.
The ACLU said the brothers were driving just a block away from their home on a snowy day when Benjamin Brown, the driver, noticed police lights flashing in the rearview mirror.
"After a taser-wielding officer ordered him out of the car, he was handcuffed, searched without cause, and detained in the back of a police vehicle, even though he had been cooperative, no weapons or contraband were found, and there was no evidence to suggest that he had been involved in a crime," the ACLU said in a statement.
However, Richards said that officers had probable cause to arrest Ryan Brown, whose YouTube video of the incident has generated more than 154,000 views.
Brown's video showed that Officer David Nelson didn't answer repeated questions about why the brothers were being pulled over and put both in handcuffs.
